Mirko Benesch

Lawyer Mr. Benesch advises companies of various sizes and legal forms throughout Germany in the areas of gambling, betting, catering, commercial and corporate law (including licensing procedures, sale and transfer of companies, commercial and construction law issues, etc.).

The legal team “Gambling and Catering Law”, which he leads, represents and supports slot machine operators, slot machine manufacturers, arcade operators, sports betting providers and restaurant owners throughout Germany in all legal matters.

Since June 01st, 2022, Mr. Benesch has also been the legal counsel of the Bavarian Slot Machine Association.

The law firm works closely with the Gambling Academy, which is responsible for the prevention training of gaming hall employees and the preparation of social concepts in accordance with § 33c GewO and the gambling laws of the federal states. Among others, Mr. Benesch teaches the legal bases for the academy during the prevention trainings.

In this context, Mr. Benesch also works for the Reutlingen Chamber of Industry and Commerce (IHK) as a lecturer for the instruction of gambling house/restaurant operators and slot machine operators within the meaning of § 33c of the Industrial Code throughout Baden-Württemberg.

In cooperation with the Zeitschrift für Wett- und Glücksspielrecht (ZfWG) (Journal for Betting and Gambling Law), the German Gambling Law Day is held in Frankfurt a.M. once a year, at which renowned speakers from research, administration and the legal profession lecture discuss current legal topics in the areas of sports betting and slot machine gambling.

Another focus is on (international) construction, architectural and real estate law. Here he represents and advises not only landlords, tenants and apartment owners but also internationally and regionally active banks, real estate and property development companies as well as builders and architects.

Lawyer Mr. Benesch is a trained mediator according to the guidelines of the Federal Association for Mediation. He is also active as an author, speaker as well as lecturer. From 2013 to 2017, Mr. Benesch was the 1st chairman of the trade association Schallstadt-Ebringen-Pfaffenweiler e.V.. Furthermore, he is a member of the Freiburger Anwaltverein e.V., the Deutscher Mietgerichtstag e.V. and the Arbeitsgemeinschaft Immobilien- und Mietrecht des Freiburger und Deutschen Anwaltsvereins as well as a member of the task force Mietspiegel der Stadt Freiburg i. Breisgau.
